Terms of Service

Effective September 25, 2026 · Version 1.1 · KINSMAN AI INC.

1. Agreement

These Terms are an agreement between you and KINSMAN AI INC. (“TheKinsman”, “we”, “us”). They cover this website, the TheKinsman booking platform and admin dashboard, the shop websites we host, and our booking forms — including forms embedded on other websites. Using any of them means you accept these Terms.

If you run a barbershop(a “shop”), everything here applies to you, including section 4 (Shop responsibilities) and section 11 (Data Processing Terms). There is no separate contract to sign: creating a shop account is your acceptance of these Terms on behalf of the business.

If you are booking an appointment(a “client”), sections 7, 8, 20 and the general sections apply to you. Your booking itself is with the shop, not with us, and the shop’s own booking and cancellation policy applies.

2. The service

TheKinsman provides scheduling, a client list, shop websites, booking forms, appointment text messages and emails, and related tools for barbershops. The shop — not KINSMAN AI INC. — provides the haircuts and other services you book, sets its prices, hours and staff, and is responsible for its own policies.

Early access. TheKinsman is a young product. Features may be added, changed or removed, and we do not promise any particular uptime, response time or service credits. We run the platform with reasonable care, but there is no service-level agreement.

3. Shop accounts

A shop account must be created with accurate information by a person authorised to bind the business. The shop is responsible for everything done under its account and the staff accounts it creates, for keeping passwords and invite links private, and for removing access when someone leaves. Tell us right away at hello@thekinsman.technology if you suspect unauthorised use.

Barbershop Mode and registered devices.A shop may register a tablet or other shared device and switch it into a shared shop session that stays signed in through the working day and asks for a personal 3-digit PIN before actions. Who can see that screen, who knows each PIN, which devices are registered, and when a device is removed are all the shop’s responsibility. Treat a lost or unattended registered device like a lost key.

4. Shop responsibilities and your clients' data

Roles. For the personal information of its clients, the shop is the business / controller: it decides why the data is collected and how it is used. KINSMAN AI INC. is the shop’s service provider / processor: we handle that data only to run the platform for the shop, under section 11. The shop is responsible to its clients and to regulators for how their data is used, inside the app and outside it.

Lawful use, inside and outside the app. The shop agrees that it and its staff will:

  • use client names, phone numbers, emails, notes, appointment history and photos only to run the shop’s own business with those clients;
  • apply the same care to anything taken out of the platform — screenshots, copied lists, numbers or photos saved to a personal phone, and any data we hand over on request — and keep it safe (New York SHIELD Act, GBL §899-bb) and, for California residents, handle it as the CCPA/CPRA requires of a business;
  • never contact a client who has replied STOP, asked not to be contacted, or has not consented, by any other means using information taken from the platform — including personal phones, other apps or other numbers;
  • send marketing texts only to clients with recorded marketing consent, and send only what that consent covers (offers and reminders from the shop); keep proof of any written or in-person consent the shop records; and follow the TCPA (47 U.S.C. §227), its rules on prior express written consent and revocation, and the CAN-SPAM Act for any email the shop sends itself;
  • obtain a client’s recorded permission before uploading their photos, and a separate recorded permission before video-recording them — video permission is only offered where the shop has enabled the training/academy option; use photos and video only as far as that permission goes; stop and delete on request; and, where the shop uses a client’s image or name in advertising, obtain the written consent New York Civil Rights Law §§50–51 requires. TheKinsman stores images and video as files only and extracts no face geometry or other biometric identifiers; the shop agrees it will not do so either (Illinois BIPA, 740 ILCS 14, where it applies);
  • not market to, photograph or record minors without a parent or guardian’s consent, and have bookings for children made by a parent or guardian (COPPA, 16 CFR Part 312; New York Child Data Protection Act);
  • use the “Blacklisted” and “Blocked” flags, and refuse or limit service, only for lawful reasons and never on a basis prohibited by the New York Human Rights Law, Title II of the Civil Rights Act of 1964, or local anti-discrimination laws;
  • supervise its staff’s use of the platform; the shop is responsible for their actions as its own.

The shop’s own policies and content. The shop publishes its own privacy policy and its own cancellation / no-show policy, posts them where clients can see them before booking, and obtains any cookie or pixel consent that trackers it adds to its website require. The shop is responsible for the accuracy and legality of the prices, hours, reviews, blog posts (including AI-drafted ones) and everything else it publishes, on its TheKinsman site or a custom domain (FTC Act §5 and state consumer-protection laws).

Shared number. Appointment texts for every shop on TheKinsman are sent from one shared phone number. A client who replies STOP to any text sent through that number becomes unreachable by text from every shop on the platform, including yours, and you will not be told why. The shop may not port, claim or advertise the sending number as its own.

Sole liability. The shop is solely responsible for all of the above and indemnifies KINSMAN AI INC. for it under section 15.

5. Acceptable use

You agree not to:

  • break the law, or use the platform to send unlawful communications;
  • send marketing messages through the platform without the recipient consents the law requires (TCPA and equivalents) — appointment consent is not marketing consent;
  • use the platform for prohibited content categories (including sex, hate, alcohol, firearms, tobacco/vape content in messaging, or medical claims);
  • probe, scrape, overload or interfere with the service or others’ data;
  • misrepresent reviews or testimonials as verified when they are not;
  • send texts that draw complaints, spam reports or unusual opt-out rates, or anything else that puts the shared sending number or our carrier registration at risk.

Because one carrier action affects every shop on the platform, we may suspend messaging for a shop that breaches this section immediately, without notice where carriers or the law require it, and otherwise with notice (section 16).

6. Embedding the booking form on your own website

Shops may embed their TheKinsman booking form on websites they own or control, subject to all of the following:

  • the form must be embedded unmodified, using the URL or snippet we provide — you may not alter, overlay or intercept it, and you may not capture, keylog or read visitors’ entries into the form from the host page;
  • the notice and consent language inside the form must stay visible and unaltered — it is how visitors receive the legally required notice at collection;
  • the host website must post its own privacy policy covering that site’s cookies and analytics and obtain any consents its own trackers require; trackers on the host page are the host’s sole responsibility;
  • booking data submitted through the form flows to KINSMAN AI INC. as the shop’s service provider and is handled per our Privacy Policy;
  • we may suspend or revoke embed access for any use that breaches these Terms.

7. Text messages — TheKinsman Appointment Alerts (SMS program terms)

Program. TheKinsman Appointment Alerts, operated by KINSMAN AI INC., sends appointment-related text messages on behalf of the barbershop you booked with: a booking confirmation, a reminder and, if the shop asks for photo permission, that request.

Frequency and rates. Up to 3 messages per appointment. Message and data rates may apply. Consent to receive appointment messages is not a condition of purchasing any good or service.

One number for every shop. All shops on TheKinsman send their appointment texts from the same phone number. Because of that:

Opting out: text STOP at any time. STOP stops all texts sent through our number, from every barbershop that uses TheKinsman, and withdraws any marketing-text consent you gave to any of them. You will receive one final message confirming that you have been unsubscribed. Text START to receive appointment texts again; START does not turn marketing texts back on — those need a fresh opt-in with the shop.

Help and support. Text HELP for help at any time, or contact us at support@thekinsman.technology.

Carriers. Participating wireless carriers are not liable for delayed or undelivered messages.

Marketing texts.Offers and reminders from a shop are a separate, optional program: up to 4 messages per month, only if you ticked the unchecked “text me offers” box on the booking form or gave the shop written consent it recorded. Consent to marketing texts is never a condition of booking. STOP ends them along with everything else.

Delivery and the shop’s allowance. Every shop plan includes a monthly text-message allowance. When a shop reaches it, appointment texts for that shop pause until the next month or until the shop upgrades; a pause is not a breach of these Terms and does not entitle the shop to a refund. The shop is responsible for watching its usage in the dashboard. Where a text cannot be sent because our messaging provider fails or messaging is unavailable, we may send the reminder by email instead if you gave one when booking. STOP applies to texts; we never send the reminder by email to a number that replied STOP.

Privacy. Information collected in connection with the program is handled per our Privacy Policy. We maintain and enforce a suppression list; shops must not attempt to reach opted-out numbers by other means using platform data.

8. Email

Giving an email address when booking is optional. If you do, we use it, on the shop’s behalf, for: a booking confirmation with a calendar invite attached; a link to give or refuse photo permission when the shop asks for it; and a reminder when a text cannot be sent (section 7). These emails come from “<shop name> via TheKinsman” and are transactional — they contain no offers. We do not send marketing email today; if we ever do, it will be a separate opt-in with a working unsubscribe link, as the CAN-SPAM Act requires. Any email a shop sends you from its own mailbox is the shop’s responsibility.

9. Fees, renewal, cancellation

Plans and prices are shown at signup and on our pricing page. Plans are billed monthly, in advance, by card through Stripe, our payment processor; we never see or store your card number. When a free trial is offered it starts at signup with a card on file, and the first charge is made when the trial ends unless you cancel before then. Your plan renews automatically each month until you cancel.

You can change plan, add or remove the website add-on, update your card or cancel at any time from Billingon your dashboard’s Barbershop page, which opens your Stripe billing portal, or by email (hello@thekinsman.technology). Cancellation takes effect at the end of the paid period; you keep access until then, and there are no refunds for partial months unless the law requires one. Add-ons are prorated when added or removed mid-period.

Each plan includes a monthly text-message allowance. Beyond it, texts stop unless you switch on extra textsin your dashboard, in which case each additional SMS segment is billed at the per-segment rate shown there, on your next invoice. We may change prices with at least 30 days’ notice by email; the new price applies from your next renewal after the notice period. Taxes are the shop’s responsibility unless we invoice them.

10. Your content, our IP, feedback, publicity

Your content. Shops keep ownership of the content they upload (logos, photos, videos, text) and grant us the licence needed to store, host and display it to run the service. The shop is responsible for having the rights and consents that content needs.

Our IP.The platform, its software, designs and branding remain the property of KINSMAN AI INC. The “via TheKinsman” wording in emails and the HELP reply is part of the service and may not be removed.

AI-assisted content.Blog drafts generated with our AI tools are produced with the shop’s own Anthropic API key and are published under the shop’s editorial responsibility. Review them before publishing; we make no promise that they are accurate, original or lawful.

Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

Publicity. We may name your shop as a TheKinsman customer, with its logo, in our marketing unless you tell us not to by email.

11. Data Processing Terms (DPA)

These Data Processing Terms apply automatically to every shop and form part of these Terms. They are written to meet the service-provider contract requirements of the California Consumer Privacy Act and its regulations (11 CCR §7051) and similar US state laws. “Client data” means the personal information of the shop’s clients that we process for the shop.

  • Limited purpose.We process client data only for these business purposes: taking and managing appointments; sending the confirmations, reminders, permission requests and service messages described in sections 7 and 8; hosting the shop’s website and booking form; storing photos and videos the shop uploads; keeping the consent and opt-out records the law requires; security and abuse prevention; and producing de-identified statistics.
  • No selling or sharing. We do not sell client data or share it for cross-context behavioural advertising.
  • No use outside the relationship. We do not retain, use or disclose client data for any purpose other than the business purposes above, or outside our direct business relationship with the shop.
  • No combining. We do not combine client data we receive from one shop with personal information from other shops or other sources, except as the CCPA regulations permit (for example the platform-wide STOP list the law requires us to honour).
  • Compliance. We comply with the CCPA/CPRA and provide the same level of privacy protection it requires of businesses.
  • Notice. We will notify the shop if we decide we can no longer meet our obligations under these Data Processing Terms.
  • Stop and remediate. The shop may take reasonable and appropriate steps to stop and remedy any unauthorised use of client data, and may ask us to confirm in writing how we are meeting these terms.
  • Consumer requests. We assist the shop with access, deletion and other consumer requests. The shop can erase a client from its dashboard; we forward to the shop any request we receive directly.
  • Subprocessors.We use the service providers listed under “Who we share with” in our Privacy Policy, each under written terms at least as protective as these. That list is our notice of subprocessors; we update it there.
  • Security. We use encryption in transit, per-shop access controls, hashed credentials and least-privilege access, as described in the Privacy Policy.
  • Breach notice. We will notify the shop without undue delay, and no later than 72 hours after we confirm a breach of security affecting its client data, so the shop can meet its own notice duties (for example under NY GBL §899-aa).
  • Deletion and return on termination. For 30 days after the account ends, the shop may ask us for a copy of its data (we provide it manually; there is no self-service export today). After that we delete client data or de-identify it. Consent records, the STOP list and the erasure log survive because the law requires us to keep proof of consent and of opt-outs.
  • De-identified data. We may create and use aggregated or de-identified data that no longer identifies anyone for statistics and service improvement, and we commit not to re-identify it.
  • Audits. On reasonable written request, no more than once a year, we will provide a written summary of our practices sufficient for the shop to verify compliance with these terms.

12. Third-party services

The platform depends on services we do not control, and their terms may apply to features they power. We are not responsible for their outages, filtering or acts. In particular:

  • Twilio and wireless carriers deliver texts and validate phone numbers when a booking is made. Carriers filter messages under the 10DLC registration rules and may block, delay or drop them; a carrier or Twilio action against our shared number or campaign affects every shop.
  • Railway hosts the application and database, and S3-compatible storage holds uploaded images and files.
  • Cloudflare delivers shop websites and connects custom domains. The shop must own or control any custom domain and manage its own DNS; activation and removal take effect after DNS and edge caches update, which can take time; we make no promise about search rankings after a domain or plan change.
  • Our email provider delivers the transactional emails in section 8.
  • Anthropicgenerates blog drafts when a shop enters its own Anthropic API key. That use is under the shop’s own agreement with Anthropic; we send it the shop’s topics and settings, never client booking data.

13. Disclaimers

The service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation, that any text or email will be delivered or delivered on time, or that AI-drafted content is accurate.

14. Limitation of liability

To the fullest extent permitted by law, KINSMAN AI INC. is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or data; and our total liability for all claims in any 12-month period is capped at the greater of $100 and the amounts you paid us in that period. This cap applies even if a remedy fails of its essential purpose. Without limiting the above, we are not liable for: texts that are undelivered, delayed or filtered by carriers; suspension of our shared number or messaging campaign by a carrier or provider; outages of the third-party services in section 12; messages paused under a plan allowance; or data the shop copied, exported or took out of the platform. Nothing here limits the shop’s indemnity or its obligation to pay fees. Some jurisdictions do not allow certain limits, so parts of this may not apply to you.

15. Indemnification

The shop will defend, indemnify and hold harmless KINSMAN AI INC. and its officers, staff and contractors from all claims, damages, fines, penalties and costs (including reasonable attorneys’ fees) arising from: the shop’s breach of section 4 or section 5; its services to clients; its content and publications; marketing consents it recorded and texts it sent; photo or video use; its treatment of minors; discrimination claims; its handling of client data inside or outside the platform; its staff, PINs and devices; trackers and modifications on websites where it embeds the booking form; and claims by its clients, staff or any third party about any of the above. We may take control of the defence of any claim that affects the platform or more than one shop, and the shop will cooperate.

16. Suspension and termination

You may stop using the service at any time (section 9 covers cancellation). We may suspend or terminate access for breach of these Terms, messaging abuse or complaint rates, non-payment, unlawful use, or risk to the platform, the shared number or other shops — with notice where practical, and immediately where carriers or the law require it.

For 30 days after termination the shop may ask us for a copy of its data. After that we delete or de-identify it. Any copy the shop receives may be used only for the shop’s own relationships with its clients, under the same rules as section 4, and never sold, shared or used to message clients who opted out. We keep the consent ledger, the STOP list, the erasure log and de-identified statistics, as section 11 explains. Sections 4, 10, 11, 14, 15, 17 and 18 survive termination.

17. Governing law and disputes

These Terms are governed by the laws of the State of New York, excluding its conflict-of-law rules. Any dispute that is not resolved informally goes to the state or federal courts sitting in New York County, New York, and both sides consent to their jurisdiction. Please write to us first at hello@thekinsman.technology; most issues can be sorted out in a few emails.

18. General

  • Force majeure. Neither side is liable for delay or failure caused by events outside its reasonable control, including carrier or provider outages, internet failures, and government action.
  • Assignment. We may assign these Terms in a merger, acquisition or sale of assets, with notice. The shop may not assign them without our written consent.
  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the service and replace any earlier discussions.
  • Severability. If any part is found unenforceable, the rest stays in force.
  • Survival. Terms that by their nature should survive (including sections 4, 10, 11, 14, 15, 17 and this section) survive termination.
  • Notices. We send notices to the email on the shop account; you send notices to hello@thekinsman.technology.
  • No waiver. Not enforcing a term is not a waiver of it.

19. Changes

We version these Terms and give at least 30 days’ notice of material changes on this page and by email to account holders before they take effect. Changes required by law or by our carriers or providers may take effect sooner; we will say so in the notice. Continued use after the effective date is acceptance; a shop that does not agree may cancel instead.

20. Client booking terms

If you are booking an appointment, this is what matters most:

  • Your booking is with the shop. The shop provides the service, sets the price, and its no-show and cancellation policy (shown before you book or posted at the shop) applies. KINSMAN AI INC. is not a party to that service and is not responsible for it.
  • “Any barber”. If you book without choosing a barber, the shop assigns one before your visit.
  • Texts and emails. Sections 7 and 8 explain what you will receive and how STOP works across every shop on TheKinsman.
  • Reaching the shop.Use the phone number or address on the shop’s website or in your confirmation to change or cancel a booking.
  • Your data. Our Privacy Policy explains what we keep for the shop and how to ask for access or deletion.
